Samsung Display Even More Irked With BOE Than Usual

The United States International Trade Commission (ITC) indicating that they have received a complaint alleging patent infringement relating to certain organic light-emitting diode (OLED) display modules and components. The complaint has been filed by Samsung Display against BOE, and it is the first complaint the company has filed with the ITC, according to Reuters.


Samsung Display is alleging violations of Section 337 of the Tariff Act of 1930 by several Chinese companies related to the importation and sale of certain OLED display modules and components in the US. The complainant requests the ITC issue a limited exclusion order, cease and desist orders, and impose a bond on the alleged infringing products during the 60-day Presidential review period.


The notice invites comments from proposed respondents, interested parties, and the public regarding any public interest issues raised by the complaint or potential remedial orders. The ITC is interested in information on how the products are used in the US, public health/safety concerns, availability of competing products made in the US, and impacts on US consumers if the products are excluded.


The nature of Samsung’s complaints against BOE may be similar to past filings with other commissions, but adding the ITC could be an indication that the company is expanding its strategy to encompass as many avenues of recourse as possible.
